ORGANIZATION / OBJECT
These General Contractual Conditions are intended to establish the terms and conditions governing the provision of travel services organized by OSCARTUR, VIAGENS E TURISMO, LDª, based at Rua do Sol Poente, 973-977, in Leça da Palmeira , with the fully paid-up share capital of EUR = 100,000.00 registered at the Commercial Registry of Porto, with the unique registration and legal person number 504 041 053, Travel Agency with RNAVT nº 2242.
The terms contained in possible particular conditions, if any, prevail over the provisions of these general conditions.

REGISTRATION / PAYMENTS
Upon registration, the customer must deposit 30% of the trip price, settling the remaining 70% up to 21 days before departure. If the registration takes place 21 days or less from the date of departure, the total price of the trip must be paid at the time of registration, subject to obtaining the supplier's part of the confirmation of reservations for all travel services. OSCARTUR, VIAGENS E TURISMO, LDª reserves the right to cancel any registration whose payment has not been made under the conditions mentioned above. Particular payment conditions: in exceptional situations conditioned by suppliers and / or times of the year, full payment may be required upon registration or confirmation of travel services.
 

REGISTRATION ASSIGNMENT
The customer can give up his registration, making himself replaced by another person who fulfills all the conditions required for the trip, provided that he informs the selling agency at least 21 days in advance and that the different service providers included in the trip accept the replacement. The assignment of registration holds the assignor and the assignee jointly and severally liable for the payment of the travel price and for the additional charges arising.
 

BAGGAGE
1) The agency is responsible for the luggage under the legal terms;
2) The customer has an obligation to complain to the service provider at the time of removal, deterioration or destruction of baggage.
3) In international transport, in case of damage to luggage, the claim must be made in writing to the carrier immediately after the damage has been verified, and at most 7 days after delivery. In case of a mere delay in the delivery of luggage, the claim must be made within 21 days from the date of delivery.
4) The filing of such a complaint will be an essential basis for triggering OSCARTUR's responsibility over the service provider.
5) The agency's liability will be limited to the maximum amount required from the service providers, under the terms of the Montreal Convention of 28 May 1999 on International Air Transport.
 

CHANGES
Whenever there are other reasons that justify it, the organizing agency may change the order of the journeys, modify the departure times or replace any of the planned hotels with others of a similar category. If unforeseen circumstances force you to suspend any travel, customers will always be entitled to a refund of the amounts paid.

PRICE CHANGE
The prices contained in the program are based on the costs of services and exchange rates in effect at the date of printing of this program, so they are subject to change resulting from changes in the cost of transportation or fuel, duties, taxes, fees and exchange rate fluctuations . Whenever there is a change in the price of the trip, the customer will be immediately informed and invited to, within the time limit set, accept the increase verified or cancel his enrollment under the same terms and conditions as those provided for in the “Impossibility of Greeting".

REFUNDS
Once the trip has started, no refund is due for services not used by the customer. Failure to provide services foreseen in the travel program for causes not attributable to the organizing agency, and if replacement by other equivalents is not possible, entitles the customer to the right to be reimbursed for the difference between the price of the services provided and that actually provided.
 

CLAIMS
They can only be considered if they are presented in writing and within a period not exceeding 20 days after the end of the provision of services. They can only be accepted as long as they have been reported to service providers (carriers, hotels, local agents, etc.) during the course of the trip or stay, requiring from them the respective documents proving the occurrence.
 

IMPOSSIBILITY OF COMPLIANCE
If, due to facts not attributable to the organizing agency, it becomes unable to fulfill any essential part of the program or if it is forced, in order to make the trip feasible, to add some service or to increase the duration of another already planned, including accommodation, it has the customer is entitled to withdraw from that, being reimbursed of all amounts paid or, alternatively, accepting an eventual change and price variation. If the aforementioned facts not attributable to the organizing agency determine the cancellation of the trip, the client may also choose to participate in another organized trip, at an equivalent price. If the proposed package travel instead is of a lower price, the customer will be refunded the respective difference. The organizing agency may not, under any circumstances, be held responsible for non-compliance or deficient compliance if it is due to situations of force majeure or unforeseeable circumstances, motivated by abnormal and unpredictable circumstances, alien to the one who invokes them, whose consequences may not have been avoided despite all the steps taken, as well as in cases where the non-provision of services was determined by the supervening of conditions that exempt legally, regulatively or contractually from the responsibility of suppliers directly or indirectly involved in it, over which the agency could exercise the right of return. In the cases not included in the previous point, the non-provision of services foreseen in the travel program for causes not attributable to the organizing agency, and if it is not possible to replace them with equivalent services, gives the customer the right to be reimbursed for the difference between the the price of the services provided and those actually provided.
 

CANCELLATION OF THE PROGRAM BY THE AGENCY
The agency reserves the right to cancel the package if the number of participants is less than the minimum required. In these cases, the client will be informed in writing of the cancellation within 8 days in advance, in which case the agency will not be liable for the termination.

DOCUMENTATION
The client must have all his personal or family documentation in good order (passport, citizen card, identity card, authorization for minors, visas, vaccination certificates and others possibly required). Birth certificates or seats are not valid as a travel document. The organizing agency declines any responsibility for refusing to grant visas, or for not allowing entry to the client in a foreign country; in these cases, the conditions established for the cancellation of the trip apply, and any and all costs incurred by the situation are still the client's account. When traveling in the European Union, customers must carry the respective European Health Insurance Card in order to obtain medical assistance. Customers who are foreign nationals must have the necessary documentation (passport, visa, residence permit, etc.) to travel or transit within the European Union depending on their nationality. For trips totally or partially outside the European Union, visas or other special documentation may be required. Always consult the Embassy or Consulate of the destination countries of your trip.
 

TRAVEL DOCUMENTS
The issuance of travel documents (airline tickets and vouchers) by OSCARTUR is subject to contractual conditions for group travel, so they cannot be issued long before the departure date. Under exceptional conditions imposed by suppliers, emissions may have to be anticipated.

INCLUDED MEALS
Meals included, whether in restaurants or hotels, will be served to the group at a fixed time and with the same menu for all participants, with no changes.

TRIPLE ROOMS
Most hotels on the OSCARTUR circuits do not have triple rooms. When hotels accept the accommodation of 3 people in the same room, it will be done in a double room with an extra bed, which may not be identical in quality and comfort.
 

ARRIVAL AND DEPARTURE HOURS
The arrival and departure times in each city are indicated in the local time of the respective country and according to the times indicated by the transport companies at the date of printing of this program, so they are subject to change. For trips made in whole or in part by bus, the indicated hours are approximate. In all modes of transport, delays resulting from technical or other reasons related to the means of transport themselves, to the transport companies, or to natural causes are highlighted.

WITHDRAWALS (GENERAL)
At any time the passenger may withdraw from the trip by written communication, having the right to refund the amounts paid deducted from the following expenses;
1- Management costs, are the expenses that the organizing agency has had to obtain travel reservations and a percentage that can go up to 15% of the price of the trip (minimum € 25.00 per passenger).
2- Cancellation costs are non-refundable expenses on the part of hotels, land transportation and accompanied visits.
3- Expenses with airline tickets when they are subject to specific conditions and cannot be refunded after being issued.
 

WITHDRAWALS (PROGRAMS WITH SEA CRUISES)
At any time the passenger may withdraw from the trip by written communication, having the right to refund the amounts paid deducted from the following expenses;
1- Management expenses, are the expenses that the organizing agency and the selling agency have had to obtain travel reservations and a percentage that can go up to 15% of the price of the trip (minimum € 25 per passenger).
2- Cancellation expenses, due to special cruise conditions, which require freight and ship supplies, in the event of the passenger giving up, the passenger is obliged to pay the following variable sums;
- 10% of the program price, in case the cancellation is made in the period between 80 to 40 days before the departure date;
- 40% of the program price, in case the cancellation is made in the period between 39 to 30 days before the departure date;
- 60% of the program price, in case the cancellation is made between 29 and 16 days before the departure date;
- Passengers who cancel within 15 days prior to the departure date, or who do not arrive in time for departure, or who abandon the ship after the cruise has started for any reason, will not be entitled to any refund.
3- Spending on airline tickets and aviation fees when they are subject to specific conditions and cannot be refunded after being issued.

ONBOARD ACCOMMODATION (SEA CRUISE PROGRAMS)
The Organizer has the power to assign the passenger a cabin different from that established in the contract, provided that it has similar characteristics. When there is an exchange of accommodation for a cabin with a lower price, passengers who are affected by this exchange will be entitled to a refund of the price difference only, according to the tariff stipulated in the catalog.

POWERS COMMANDER SHIP (PROGRAMS WITH SEA CRUISES)
Passengers are informed that, according to international navigation standards, the ship's captain has full powers to: tow or assist other ships in any circumstance, deviate from the initial route, change any port (whether or not it is in or out) on the ship's itinerary), transfer the passenger and his luggage to another ship for the continuation of the voyage, refuse boarding to anyone who is not in his right mind or in health conditions that allow the continuation of the voyage or cause damage to others. passengers. The passenger will be subject to the commander's powers in all matters concerning security on board. RESPONSIBILITY
OSCARTUR's liability, arising from the assumed obligations, is guaranteed by civil liability insurance at the Tranquilidade Insurance Company, with policy number 0001791902, in the amount of EUR = 75,000.00 and by the Travel and Portugal Tourism Tourism
 

VAT
The prices mentioned already reflect the value added tax (VAT) at the current rate.
 

AVIATION FEES
The values ​​of the airport, security and fuel fees for our circuits, were calculated at the date of printing (01.06.2020) referring to the disclosure of trips from June 2020 to June 2021. Due to constant changes, they are subject to price reconfirmation up to 21 days before departure date.

HARBOR DUES
The values ​​of port fees and fuel supplement for the suggested cruises, were calculated at the date of printing (01.06.2020) referring to the disclosure of trips / cruises from June 2020 to June 2021. Due to constant changes, they are subject to reconfirmation of the price up to 21 days before the departure date.
